The instruction offered by CorePlus is limited to that of Pilates, yoga and fitness training, and I understand that CorePlus classes can involve intensive physical activity.

I acknowledge that there are risks associated with participation in the activities and programs offered by CorePlus and I freely accept these risks.

I am not aware of any medical condition that would affect my ability to participate in the activities and programs offered by CorePlus and if I have any concerns about my medical condition I will consult with my physician before participating in the activities and programs offered by CorePlus.

We advise you to chat with your doctor or obstetrician to help you decide what's best for you and recommend obtaining a letter of clearance before commencing any classes.

CorePlus is committed to providing an inclusive and safe environment for all members. Members are required to disclose any medical conditions that may affect their ability to safely participate in classes. CorePlus reserves the right to request medical clearance from a qualified healthcare professional to ensure the safety of the member and other participants. Reasonable accommodations will be made wherever possible, provided they do not impose an undue hardship or compromise the safety of others.

CorePlus retains the right to refuse services where deemed necessary and reasonable.

I acknowledge that I will inform the instructor if I am pregnant before participating in any class. Our Mat classes are heated so we recommend avoiding these classes altogether while you are pregnant. Please refer to our Pre and Post Natal Movement Page for more information.

CorePlus does not take any responsibility for personal items brought into or left at its premises.

Memberships and class passes are not refundable or transferable unless otherwise agreed by CorePlus in writing.

1. Assumption of Risk

I understand that participation in Pilates, yoga, and any other fitness-related activities at CorePlus and its affiliated studios, franchisees, and locations involves inherent risks, including but not limited to muscle strain, falls, equipment failure, physical exertion, exposure to infectious diseases, and pre-existing medical conditions exacerbated by exercise. I voluntarily choose to participate despite these risks and assume full responsibility for any injury, illness, or damages that may result.

2. Release and waiver of liability

I, on behalf of myself, my heirs, personal representatives, and assigns, hereby release, waive, discharge, and hold harmless CorePlus, its owners, directors, employees, contractors, agents, affiliates, and successors (collectively, "Released Parties") from any and all liability, claims, demands, or causes of action arising out of my participation, whether caused by negligence or otherwise.

This release applies to personal injury, death, property damage, economic loss, or any other damages suffered by me while participating in activities at CorePlus.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, demands, losses, liabilities, costs, or expenses (including attorney's fees) that arise from my actions, participation, or failure to comply with this agreement.

4. Warranty as to health

I confirm that:

• I am physically fit and have no medical condition that would prevent me from safely participating in fitness activities.
• I have disclosed any medical conditions, injuries, or other concerns that may affect my participation.
• I agree to stop participation and seek medical attention if I experience dizziness, pain, excessive fatigue, or any other health concern.
• I understand that CorePlus is not responsible for any medical expenses incurred due to participation.

5. COVID-19 and infectious disease disclaimer

I acknowledge that:

• CorePlus cannot eliminate the risk of exposure to COVID-19 or other infectious diseases.
• I will follow all safety protocols, including hygiene practices and social distancing, as required by the studio.
• I waive any claims related to exposure, infection, or complications arising from COVID-19 or other infectious diseases.

6. Purchase and cancellation policy

I understand that:

• All purchases, including memberships, class packages, and single-class passes, are non-refundable unless otherwise required by applicable state law
• If I wish to cancel a recurring membership, I must provide 30 days' written notice
• If I purchase a membership online, I may have the right to cancel within a specific timeframe as determined by the consumer protection laws of my state of residence

7. Class action waiver and dispute resolution

To the fullest extent permitted by applicable law, I waive any right to participate in a class action lawsuit against CorePlus and its affiliated studios for any claims arising out of or related to this agreement. Any dispute shall be resolved on an individual basis through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in the county where the studio I attend is located, and the arbitrator's decision shall be final and binding.

8. Photo and Video Release (Optional)

I grant CorePlus the right to use photographs or videos of me taken during classes for promotional purposes. I understand that I can opt out of this provision by notifying CorePlus in writing.

9. Severability

If any provision of this agreement is found to be unenforceable, the remainder shall continue in full force and effect.

10. Applicable law and venue

This agreement shall be governed by the laws of the state where the studio you attend is located. Any disputes shall be resolved in the county and state where that studio operates. For online purchases or enrollments not associated with a specific studio location, this agreement shall be governed by the laws of the state where CorePlus maintains its principal place of business, and disputes shall be resolved in that state.

The Franchise Agreement will be governed by the laws of Delaware, and the Franchise Agreement requires that disputes arising in connection with the Franchise Agreement be litigated in Delaware.  In some instances, certain laws or regulations of the state in which the Franchised Business is located may apply.

All prices quoted for goods and services are exclusive of tax which is applied at checkout.

CorePlus may, from time to time at its absolute discretion, vary its prices based on, amongst other things, any change in the cost of providing these goods and services to you, by providing prior written notice. Any changes to the prices will take effect from the date specified in the notice.

Participating Studios
All independently owned and operated CorePlus studios carrying on business under the CorePlus brand (Franchisees) and online through our website.

1. These Terms

1.1 You agree to these Terms when you purchase, activate, redeem, enquire or attempt to use a Gift Voucher.

1.2 CorePlus may amend these Terms at any time without notice.

1.3 Where you purchase these Gift Vouchers as a personal or business gift, or for other business uses approved by CorePlus, you must ensure that the end gift voucher holder is made aware of these Terms, including the expiry date.

2. Purchase of Gift Vouchers

2.1 The Issuer issues physical gift vouchers and electronic gift vouchers.

2.2 All Gift Voucher purchases are final and cannot be refunded under any circumstance.

2.3 Physical Gift Vouchers may be purchased from CorePlus corporate offices and from any participating studio carrying on business under the CorePlus brand

2.4 Electronic Gift Vouchers may be purchased directly from our website, (www.core-plus.com)

3. Redemption of Gift Voucher

3.1 A Gift Voucher has no value unless activated in our gift voucher system and payment has been made.

3.2 A Gift Voucher may be redeemed for goods and services purchased from any participating studio carrying on business under the CorePlus brand

3.3 When a Gift Voucher is presented to a participating studio, CorePlus will authorize the studio to provide credit up to the balance of the Gift Voucher as identified in our system, against the purchase price due to the studio. If the purchase price exceeds the balance of the Gift Voucher, the gift voucher holder must pay the difference using another payment method. No change will be given and any balance on the Gift Voucher may only be used in whole or in part against future purchases.

3.4 A Gift Voucher cannot be redeemed for cash.

3.5 When redeeming gift vouchers, some memberships including contracts can only be processed directly by our team. If you experience any difficulties redeeming your gift card, contact your local studio directly using the contact details on our website: https://www.core-plus.com/studios

4. Expiry Date

4.1 A Gift Voucher expires 36 months from date of issue.

4.2 Any balance remaining on a Gift Voucher after the expiry date will not be able to be redeemed by the Gift Voucher holder.

4.3 A Gift Voucher cannot be re-activated at any time.

5. Lost and Stolen Gift Vouchers

5.1 A Gift Voucher must be treated as cash as it will not be reissued, refunded or honoured if lost or stolen.

5.2 A Gift Voucher will only be reissued or honored where the Gift Voucher is shown to be faulty or damaged due to our fault or a participating studio's fault, or where there has been a breach of any condition or warranty implied under Consumer Law.

6. Enquiries and Complaints

6.1 For complaints or enquiries about Gift Vouchers, please contact our corporate office on 1300 COREPLUS.

6.2 For complaints or enquiries about goods or services purchased using a Gift Voucher, please contact the relevant participating studio where the goods or services were purchased.

7. Jurisdiction

7.1 These Terms and Conditions are governed by the laws of the United States of America and you agree to the non-exclusive jurisdiction of the Courts of that jurisdiction

Terms and Conditions

These Terms and Conditions govern your access to and participation in the CorePlus At Home Workouts. By accessing and participating in the CorePlus At Home Workouts, you acknowledge that you have read and agree to these Terms and Conditions.

Compliance with Instructions

You agree to comply with all directions and guidelines provided by CorePlus regarding the CorePlus At Home Workouts, including all instructions for proper and safe participation

Warranties and Representations

CorePlus makes no representations or warranties regarding the CorePlus At Home Workouts or any results or outcomes associated with your access and use, other than those expressly stated herein.

Age Requirements

You represent and warrant that you are at least 18 years of age or have obtained your parent/guardian's permission to access and participate in the CorePlus At Home Workouts

Health and Safety

If you are pregnant or have recently given birth, you warrant that you have obtained medical clearance prior to participating in the CorePlus At Home Workouts and acknowledge that some or all of the workouts may not be suitable for you.

As with any exercise program, participation in CorePlus At Home Workouts involves certain health and safety risks. Each time you participate, you warrant that you have created a safe environment, are physically able to participate, and are not suffering from any injury, illness, or condition that may prevent safe participation. You acknowledge that your participation is at your sole risk. 

You agree to immediately stop participating should you experience faintness, shortness of breath, pain, dizziness, or become aware of any injury, illness, or condition that prevents safe participation.

Intellectual Property

The CorePlus at Home Workouts are the property of CorePlus and all copyright, trademarks, design rights and other intellectual property rights in relation to the CorePlus At Home Workouts belong to CorePlus

You are prohibited from reproducing, copying, sharing, selling, or otherwise dealing with the CorePlus At Home Workouts without CorePlus's written consent.

Limitation of Liability

To the maximum extent permitted by law, CorePlus shall not be liable for any injury or damage whatsoever, including damages for loss of income, personal injury, or property damage, except where such limitation is prohibited by law.

Indemnification 

You agree to indemnify and hold CorePlus harmless from all liabilities, claims, and expenses arising from your use or misuse of the CorePlus At Home Workouts

Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms and Conditions shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the state where CorePlus maintains its principal place of business.

Class Action Waiver

You agree to resolve any disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any part of these Terms and Conditions is deemed unenforceable, the remaining provisions shall remain valid and enforceable.

Governing Law

These Terms and Conditions are governed by the laws of the state where CorePlus maintains its principal place of business, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the federal and state courts located in that state.

Franchisee Relationship

CorePlus may operate through a network of independently owned and operated franchisees. Each franchisee is responsible for its own operations. These Terms and Conditions apply regardless of whether you access CorePlus At Home Workouts through the franchisor or an authorized franchisee.

Modification to Terms

CorePlus may modify these Terms and Conditions at any time. Your continued participation in the CorePlus At Home Workouts following the publication of updated Terms and Conditions on our Website constitutes acceptance of those changes.

Privacy Policy

Your personal information will be used by CorePlus and our payment processor in accordance with our Privacy Policy to provide you with services covered by these Terms and Conditions. 

CorePlus will only disclose your information to third parties as required by law or as outlined in our Privacy Policy. Our Privacy Policy complies with applicable U.S. federal and state privacy laws, including the California Consumer Privacy Act (CCPA) where applicable. 

You must not photograph or record CorePlus instructors or other clients without their express consent.

By participating in CorePlus At Home Workouts, you consent to CorePlus using your image in promotional materials, including social media platforms.

CorePlus is not liable for failure to perform arising from events beyond its reasonable control, including but not limited to: industrial disputes, strikes, lockouts, accidents, breakdowns, import or export restrictions, acts of God, pandemics, acts or threats of terrorism, or war. If a Force Majeure event occurs, CorePlus may suspend or terminate this Agreement by written notice.

For the purposes of these Terms and Conditions, the following definitions apply:

• CorePlus means Core Plus Group USA and its related entities, franchisees, and affiliates
• CorePlus At Home Workouts means classes designed for online access and viewing, delivered via our Website, App, social media platforms, or other means.
• Terms and Conditions means these terms and conditions as amended from time to time.
• Website means core-plus.com
• You means the individual accessing and using the CorePlus At Home Workouts.
